Mexico’s Supreme Court Decriminalizes Abortion Based On Constitutionality

On Wednesday, the Supreme Court of Mexico declared that the current restriction on abortion is unconstitutional and ordered that it be decriminalized at the federal level.

“The First Chamber of the Court ruled that the legal system that penalizes abortion in the Federal Criminal Code is unconstitutional, since it violates the human rights of women and people with the capacity to gestate,” the Supreme Court said on social media.

Twelve Mexican states have already decriminalized abortion. According to Reuters, the most recent decision, which was made just days ago in the central state of Aguascalientes, was applauded online with social media users posting green hearts in support of it.

The symbol of the “Green Wave,” the social movement for reproductive rights that has swept over Latin America since the turn of the century, is a heart.

In 2021, the Supreme Court of Mexico declared for the first time that criminalizing abortion was against the Constitution, overturning a statute in the state of Coahuila that threatened women who had abortions with up to three years in prison and a fine.

Following the US Supreme Court’s decision to overturn Roe v. Wade in June 2022, the nation has unintentionally evolved into a paradise for Americans.

A pro-choice activist named Verónica Cruz told CNN in 2022 that she was shocked to see Mexico “moving forward, while the US is going backward.”
